Definition and Class Characteristics

Under general direction, mediates disputes regarding child custody and visitation issues and prepares written reports with recommendations that are the best interest of children; performs other related duties.

This is a journey level position. Employees in this position are responsible for providing alternative dispute resolution services and facilitate problem-solving in child custody and visitation disputes. Employees are responsible for reviewing court files and interviewing parties to assess potential for stipulation or resolution, investigation of facts and conditions surrounding the controversy and recommending an appropriate child custody and visitation plan in writing.

Essential Duties

Duties may include, but are not limited to, the following:

Reviews court case information prior to conducting mediation; prioritizes assigned cases; meets with parties to explain mediation process and explore child custody and visitation options with the parents; encourages parental involvement in the mediation process; conducts collateral contacts to obtain and /or verify information pertinent to child custody and visitation issues; responds to inquiries from customers, parents, minors counsel, community agencies and others.

Conducts confidential mediation of assigned cases to facilitate development of a child custody and visitation plan agreement between the parties involved; facilitates and encourages negotiations between parties during the mediation process; works together with the parties and other agencies to ensure the best interests of the child are being met; when an agreement (stipulation) between the parties cannot be reached in mediation, develops and submits a recommended child custody and visitation plan to the court in a formal court report format.

Works with various parties and agencies such as the Department of Public Social Services, Child Protective Services (DPSS/CPS), parents, children, therapists and minors counsel.

During the mediation process, observes and assesses risk factors, including domestic violence, substance abuse, child abuse issues and potential for danger to self and others and takes appropriate action to ensure the safety and best interest of the child; reports suspected child abuse and neglect allegations to appropriate authorities in accordance with statutory requirements; when intensive or continued counseling is appropriate, that information is included in the court recommendation; completes required reports and contacts pertinent agencies to obtain collateral information as appropriate, including but not limited to, CPS, mental health agencies, substance abuse treatment providers, school personnel, supervised visitation monitors and law enforcement personnel as necessary and required by law.

Provides expert professional assistance, guidance and support to customers, the court and the public; handles and responds to numerous daily inquiries from customers, parents, community agencies and others; keeps abreast of current developments in family law and clinical studies, trends and requirements pertaining to child development and mental health.

Performs responsible and specialized administrative duties related to areas of responsibility, such as: accessing, and reviewing case information within the database; maintaining daily case related statistical data and collateral contact information as requested; providing testimony when subpoenaed by parties or their counsel; as required or as requested, completes other assigned court-related written reports and recommendations for the court and for the attorneys of records.

Participates in research applicable to areas of responsibility; participates in state and regional training institutes and recurring training sessions, including domestic violence and mediation training to meet continuing education requirements for Child Custody Recommending Counselors as set forth in Rule of Court Section 5.210.

Participates in monthly case consultation meetings and, quarterly staff meetings, and provides regular status reports on workload.

Monitors current developments in family law, juvenile law, social service policies and regulations, clinical studies and other information and trends pertaining to child development, family dynamics, healthy partner relationships, mediation and alternative dispute resolution.

Communicates clearly, concisely, and effectively orally and in writing; exercises tact, objectivity, sensitivity, discretion, courtesy, and judgment in handling highly emotional issues and situations with a variety of people from a diverse, socio-economic and cultural backgrounds.

Establishes and maintains effective working relationships with judicial officers, other staff, members of the public, the parties and others encountered during the course of work.

Performs other duties as assigned.

Minimum Qualifications

License or Certifications:

For Family Law conciliation assignments, employees must meet criteria outlined in the Family Code Section 1815 and 1816. The code specifies that persons employed in this capacity must possess:

(1) A master's degree in psychology, social work, marriage, family and child counseling, or other behavioral science substantially related to marriage and family interpersonal relationships, AND

(2) At least two years of experience in counseling or psychotherapy preferably in a setting related to the areas of responsibility of the family conciliation court and with the diverse population to be served.

Knowledge of: Principles, practices and techniques of alternate dispute resolution; factors contributing to the development of behavioral issues and individual disputes; mediation and negotiation theories and techniques, individual and group counseling techniques; laws, regulation and professional practice relating to dispute investigation and resolution; legal terminology, court operations and courtroom procedures and courtroom etiquette as used in Family Law cases; governmental and private community resources and referral agencies; knowledge of principles and practices of mental health; adult psychopathology; psychology and socio-economics of the family unit; characteristic and signs of abuse, domestic violence and substance abuse; clinical issues relating to family dysfunction, effects of divorce/domestic violence on children and child behavior/development; law as related to visitation, custody and parental rights; juvenile delinquency and dependency issues; general functions and organization of the judicial system, including the various divisions of the court and the roles and functions of other legal and law enforcement agencies; current trends and issues in the field of counseling, social work and psychology; legal and ethical issues pertaining to delivery of professional services; and correct use of the English usage, including spelling, grammar and punctuation.

Ability to: Mediate and resolve disputes; understand laws and statutes as related to assigned disputes; reach logical and sound conclusions based on evaluation of facts and conflicting information; establish rapport with clients; facilitate individual problem recognition, identification and solution; work in an environment with conflicting parties; effectively conduct interviews under stressful and/or hostile circumstances; put emotional and hostile individuals at ease; tactfully deal in a pleasant, non-confrontational manner; identify and utilize support services and community resources; establish
